CANCELLATİON POLİCY

RİGHT TO CANCEL

You can cancel your contract in writing (e.g. by letter, fax or email) within 14 days without giving any reason or - if you receive the goods before the end of this period - by returning the goods. The period begins on receipt of this policy in writing but not before receipt of the goods (in case of recurring delivery of similar goods, not before receipt of the first part-delivery) and not before we have met our obligations to provide information under Article 246 § 2 in conjunction with § 1.1 and § 1.2 of the EGBGB. The cancellation deadline is deemed to have been met if the cancellation notice or the goods are dispatched in good time. The cancellation notice should be sent to: Energetix GmbH & Co. KG, Franz-Kirsten-Strasse 1, 55411 Bingen, Germany.

CONSEQUENCES OF CANCELLATİON

In the event of effective cancellation, the goods received by the one party and the payment received by the other shall be returned and any derived benefits (e.g. interest) surrendered. If you are unable to return or surrender all or some of the goods and benefits (e.g. benefits of use) or are only able to return or surrender them in a deteriorated condition, you must compensate us for the loss of value. You will be liable to compensate us for the loss of value incurred only if it arises from a handling of the goods that goes beyond an examination of their characteristics and function. "Examination of their characteristics and function" means the testing and trying out of the goods in a way that is possible and customary in a retail store. Goods that can be sent as parcels should be returned at our expense and risk. Goods that cannot be sent as parcels will be collected from your address. Payments must be refunded within 30 days. For you the period begins when you send off the cancellation notice or the goods, for us it begins when we receive the notice or the goods.
